Please read this User Agreement carefully, including the Landers Photography School (“LPS”) Privacy Policy.

YOUR USE OF THE SITE CONSTITUTES YOUR AGREEMENT TO ALL TERMS, CONDITIONS, AND NOTICES CONTAINED ON THIS PAGE.

By accessing and using the Site, you accept and agree to be bound, without modification, limitation or qualification, by these terms. If you do not accept any of the terms stated here, you must not use the Site. The right to access and use the Site is not transferable to any person or entity. LPS may, at its sole discretion, modify or revise this User Agreement at any time by updating this posting. Users are bound by any such modification or revision and should therefore visit this page periodically to review the User Agreement. When you continue to use the LPS Site after we post a change, it means you agree to the new rules.

Privacy Statement

Please review our Privacy Policy, which is part of this User Agreement and describes our data collection policies, privacy measures and treatment of personal information of Site users.

Changes

LPS reserves the right at any time and from time to time, to modify or discontinue, temporarily or permanently, the Site and any and all features and sections contained on it, with notice to registered users provided by posting to the Site, or email if the user has requested email updates, and immediately in the event of technical difficulties. LPS shall not be liable to any User or to any third party for any such modification, suspension or discontinuance.

 

Returns, cancellations, and exchanges

Events= classes, workshops, seminars, events, etc.

Canceled Events - If your event was canceled, in most cases you won't need to do a thing: we'll inform you of the cancellation and refund the amount you paid, including any fees (except UPS and retail pickup) on the same payment method used for purchase.

Rescheduled Events - If your event was rescheduled, we'll contact you with the new date and time ASAP. Can't make it? -we will refund the amount you paid, including any fees (except UPS and retail pickup) on the same payment method used for purchase.

Refunds and Exchanges

All events are fully refundable for 24 hours after purchase, up until one week before the event (class) when there are No Refunds or Exchanges. Please note, when you purchase a class, seminar, workshop, season pass, event entry fee, etc, you are purchasing a seat (or entry into an event), if you fail to fill the seat, that's on you. We create the opportunity, but you must show up on your own, without our assistance. But we understand, if something comes up closer to the event and you can't make it, we'll do everything we can to help. Just contact us!
 
Example: If you purchase a season pass and six months later you realize that you haven't been to a single workshop or seminar, then you better start going to some! But this does not qualify for a refund. We provide opportunity. We make sure that there is water in the horse trough, but we have no ability to make him drink!
 

Landers Photography School's Product Return Policy

Our return policy for all Landers Photography School products is as follows:

Landers Photography School will, in its sole and absolute discretion, allow for the return or replacement of any product purchased using our services within 60 days from the date of purchase. For recurring billing products, returns for more than one payment may be provided if requested within the standard 60 day return period.

If a customer requests a return and the return is approved by Landers Photography School, the money for the requested transaction is refunded back to the customer, in part or whole. If the return is for a recurring billing product, then the return policy allows for the most recent payment to be refunded. Multiple payment returns can be provided as long as they are within Landers Photography School's Return Policy. A return on a recurring billing product will also result in cancellation. Returns will only be credited back to the account used to make the original purchase. If the original account has been closed, the purchase is not eligible for return.

When a product is returned, the customer generally receives a full refund. Due to the digital and informational format of Landers Photography School products, when a refund is requested, the customer retains the product and, in many cases, the customer has received a benefit from the product prior to the return. In such cases, Landers Photography School reserves the right to issue a refund for less than the full purchase price.

Our vendors are not permitted to make any guarantee that conflicts with our return policy. If you find a product sold through Landers Photography School with any warranty that conflicts with our return, cancellations, and exchanges policy, please bring it to our attention so that we may take corrective action.

 

Reasons Why a Purchase May Be Refunded

Landers Photography School has every incentive to keep customers happy by providing quality products and service. To promote customer satisfaction, Landers Photography School reserves the right to reverse a sale, including but not limited to the following:

  • If the customer provides a valid reason for requesting a return within 60 days of purchase;
  • If the customer provides a valid report that the charge was fraudulent or unauthorized;
  • In order to comply with credit card industry rules, ACH industry rules, PayPal terms of service, U.S. law, and requests from verified US judiciary or law enforcement agents; or
  • For any other reason Landers Photography School deems appropriate.

 

Recurring Cancellation Policy

A customer may cancel a product with a recurring billing subscription at any time. A cancellation means that no future payments are charged to the customer's account. The cancellation of a recurring billing product does not generate a refund - it will only stop any future payments.
 

Abuse of the Return Policy

Customers requesting serial or repeated returns may be blocked from making further purchases. Customers that violate the terms of use of a product may have their right of return revoked for such product.

 As a condition of registering with Landers Photography School and using the Landers Photography School services, you expressly acknowledge that you have read and understand this Return and Cancellation Policy and you agree to be bound by its terms and conditions. If at any time you disagree with this Return and Cancellation Policy or any part of it, your sole remedy is to cease all use and terminate your account. Please note, however, that any transactions which occurred prior to the date of such termination shall be governed and controlled in full by the terms of this Return and Cancellation Policy.

Copyright - Use of Content

Access to and use of text, artwork, photographs and other files on the Site are subject to the following terms and conditions:

All Content on the Site is Protected by Copyright Laws

The Site, and all materials contained within the Site, including images, text, software, documentation, audio and video clips, are protected by copyright, trademark and other laws and may be covered by other restrictions as well. LPS and applicable third parties own or have acquired all rights in the Site and the materials contained within the Site. LPS expressly prohibits the copying and distribution of any protected materials on the Site, except for the purposes of fair use as defined in the copyright laws. Fair use of copyrighted material includes the use of protected materials for noncommercial educational purposes, such as teaching, scholarship, research, criticism, commentary, and news reporting, so long as you do not use more than you need for the permitted purpose and you do not interfere with an established market for licensing the material. Unless otherwise noted, users who wish to download or print any text or image files from the Site for such uses are welcome to do so without the express permission of LPS. Users must cite the author and source of this material as they would material from any printed work; the citation should include the URL "http://www.LandersPhotoSchool.com"

A fair use analysis depends on individual facts. By downloading, printing, or otherwise using content from the Site, users agree that they will limit their use of the protected materials to fair use, will not violate the proprietary rights of LPS or any other party, and will be solely responsible for any violation.

Commercial Use is Prohibited

Unauthorized commercial exploitation of protected materials is specifically prohibited. Anyone wishing to use any of files or images contained in the Site for commercial use or any purpose other than fair use as defined by the copyright laws, must request and receive prior written permission from LPS and, if necessary from the third parties that licensed the materials to LPS. LPS and third parties own many of the trademarks, service marks, and logos, whether registered or unregistered, (collectively, the "Trademarks") displayed on this Site. Nothing contained in this Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademarks displayed on the Site without the express written permission of LPS or any third party that may own the Trademarks displayed on the Site. Any unauthorized use of the Trademarks, except as authorized in this User Agreement, is strictly prohibited. You agree not to use LPS's name or any of the Trademarks in any manner, including any advertising or promotional materials, that is likely to cause confusion about whether we are the source, sponsor, endorser or affiliated with any product or service. You also agree not to use LPS's name or any Trademarks to falsely suggest any relationship between you and us. In addition, you may not use our trademarks in any manner that disparages or discredits us or infringes or violates any of our rights.

Links, Frames and Metatags

You may link to the home page of the Site as long as the link does not cast us in a false or misleading light. LPS prefers advance notice of such linking, which can be provided by contacting LPS via info@LandersPhotoSchool.com. You may not frame any content contained on the Site. You may not use LPS's name or Trademarks in metatags, targeted advertising keywords (such as Google's AdWords) or any other form of "hidden text" without our express written consent.

Links to Other Web Sites

The LPS Site contains links to other websites that we think may be of interest to you. We have no control over these other sites or their content. Remember that when you link to another site, that other site is governed by its own user agreement and privacy statement, which you should be sure to read. LPS has not reviewed all of the sites that link to the Site and is not responsible for the content on any of those sites linked to the Site. If you use a link to visit any other site, you do so at your own risk.

Disclaimers and Limitation of Liability

THE SITE, INCLUDING THE UNDERLYING SOFTWARE, AND ALL CONTENT CONTAINED ON THE SITE IS PROVIDED "AS IS." TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND ANY THIRD-PARTY CONTENT PROVIDERS OR LICENSORS ("CONTENT PROVIDERS") DISCLAIM ALL WARRANTIES OF ANY KIND (EXPRESS, IMPLIED OR OTHERWISE) REGARDING THE SITE OR CONTENT CONTAINED ON THE SITE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OWNERSHIP, AND NON-INFRINGEMENT.

Indemnity

You agree to indemnify and hold harmless LPS, its officers, employees, and agents, against all claims, actions, suits, damages, liabilities and costs (including, without limitation, reasonable legal fees) resulting from your breach of any provision of this User Agreement or your use of the Site or any protected materials.

Termination

We reserve the right to terminate the Site and this User Agreement at any time without notice for any reason, including, in the case of the User Agreement, for your violation of any of its provisions. The Limitation of Liability, Indemnity and Governing Law Sections of this User Agreement survive any such termination.

Governing Law

This User Agreement is governed by the laws of the State of Texas applicable to contracts made and performed there without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts in the State of Texas and Bexar County and waive any jurisdictional and venue or inconvenient forum objections to such courts.

General

If any provision of this User Agreement is held to be invalid or unenforceable, that provision, to the extent unenforceable, shall be struck, and shall not affect the validity or enforceability of the remaining provisions. Headings are for reference purposes only and in no way define or limit the scope or extent of that section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This User Agreement set forth the entire understanding and agreement between us with respect to the subject matter of this User Agreement.
 

Items donated to charities and other organizations

If your donation certificate is lost, stolen, damaged, or destroyed, please contact us. We are happy to help.
